Employer liability and employer's declaration

Questioner

Dear, My employer refuses to give me an employer's statement. Not because they are afraid to give a permanent contract but because they believe that the bank can hold them responsible as an employer. They describe a situation in which I will no longer be employed in a few years and will get into financial trouble, if I could no longer make ends meet the bank could hold the employer liable for any debts. A situation I cannot imagine and as far as I know has never happened before. However, my employer is being talked into this by a well-regarded lawyer. My question is whether this is correct, can the bank hold the employer financially liable if I get into debt? The employer is prepared to think along but as you can understand I need hard facts to refute these objections. After all, the employer does not want to take any risks. It is difficult to find anything online about the liability of the employer by the bank. That is why I am asking the question here, I need hard evidence to refute these objections, I hope to find it here. Thanks in advance for thinking along. Yours sincerely, Anonymously

An employer's statement is a snapshot. The employer declares what the situation is at this moment and that you will remain in his service for at least 1 year. A bank cannot hold the employer liable for the fact that something changes in the situation after that year. Based on your financial information, a bank decides whether or not you will receive a mortgage. The employer's statement is only intended to say that this situation will last for at least 1 year. I have been doing employment matters for over 30 years now, but I have never heard as much nonsense as your employer is telling you. Either your employer is seeing ghosts or there is (much0 more going on than he wants to say. According to you, the employer would be advised by a reputable lawyer. I would ask for the name of this lawyer and contact him directly. You may then hear further substantiation of this ridiculous position. After that, I would go to a specialized employment lawyer for further legal advice.
