Labor Law: Breaks and Employer Obligations

Questioner

Hello, The employment regulations of 1 April 2015 state that breaks must be taken. Can a half-hour break be withheld retroactively per day if no break has been taken?

Lawyer

It is the employer's duty to give his employee a break and to ensure that the break is taken. If he does not do this, the employer can also be fined for this because he violates the Arbotijdenwet. Whether or not the employer pays the break is up to him, unless otherwise agreed in an agreement and/or CAO.
