Legal advice on getting your watch back | Rechtswinkel.nl

Questioner

Some time ago I brought a watch to V&D for repair. They sent it to an external company to repair it but then V&D went bankrupt. Now the watch has been repaired by the manufacturer under warranty and it is still with the external company but they do not want to give it back to me. I understand that they still want to see money from V&D but they cannot use my watch as collateral? What do I need to do to get my watch back?

You will have to request the curator in writing to retrieve your watch. If they do not cooperate, the only option is to take the matter to court and claim its return. If you would like help with this, please feel free to contact me

How annoying that the external company to which V&D sent your watch for repair now does not want to return your watch. I would like to know a little more about your case (including the name of the external company for the repair) and perhaps we can offer you the opportunity to address your problem in our program. I am working for the new SBS6 television program 'Meester Frank Visser doet Uitspraak' in which Mr. Frank Visser resolves high-profile issues and conflicts. You may know Mr. Frank Visser from the TV program 'De Rijdende Rechter' (started by him over 20 years ago because he believed that all people have the right to justice. And he still believes so!) If you are interested, please do not hesitate to contact us, we may be able to help you. If your 'problem' has now been resolved - then we are of course happy for you! I give you little chance because the manufacturer is invoking a right of retention in the bankruptcy. V and D gives you a guarantee, I understand, and the manufacturer repairs the watch and has an enforceable claim. You can of course report to the trustee as the owner of the property, because if the claim is paid, you can get your watch back.
