Legal assistance for software problems

Questioner

I bought a computer program on the internet, which I cannot install. I have contacted the supplier about this several times, he sent all kinds of files that I had to install, and then it would work. But I couldn't get it to work. Now it turns out that the program only works with Windows XP, which I haven't used for a long time and it's not a good idea anymore. So I said I want to take the case back because it is not a proper product and I cannot use it. But now he comes up with the answer that software is not taken back. I then asked him if he had a solution and if he would help me further, and that if not, I really wanted my money back. I have already sent several emails and WhatsApp messages but I have not received any response, he simply leaves me hanging. What can be done about this?? It is not about a large amount, but has now become a matter of principle.

Lawyer

You must give the party a final written notice of default, with the request to come up with a solution within a reasonable period. If the party does not want to cooperate, the only option is to dissolve the purchase through the court. If you want further help and/or advice, please feel free to contact me.

Questioner

Thank you very much for your quick response. In the meantime, I have done what you advised and given him one last 'chance' to help me or reverse the matter. That was a few days ago, in which I mentioned the latest date of January 20. No response yet, had asked for email read receipt. He also did not open a WhatsApp message, as can be seen from the check marks (still gray). What is wise now, should I wait for that date??, or see if I can get in touch with him. Maybe he is on vacation and can't respond??

Lawyer

I would wait a little longer until the term you yourself have given. If he does not respond, you or a lawyer hired by you can still send a final reminder. If he still does not respond, you can still make a case out of it. After all, it is possible that he is on holiday. If you would like further help and/or advice, please feel free to contact me.

Questioner

Okay, then I'll wait until January 20th.
