Ir/Madam, We have purchased a commercial property with a commercial residence, both with a municipal designation 'commercial'. Are we allowed to set up an office in the commercial residence or is this residence only for residential use? Who is allowed to live in this residence? It is striking that according to you the house has the destination 'business'. This means that the house should not be used as a house but only as a business according to the definition of the destination 'business' of the zoning plan! I advise you if you cannot deduce the destination from the documents you have, to make an appointment with the municipality to be able to view the zoning plan and to receive an explanation from a municipal official. Thank you very much for your quick response. The zoning plan states a single business destination, with the functional designation company home (the land registry drawing also states bw). But the entire plot is purple, which means business destination. That makes it so unclear, because does this company home have to be lived in or is it allowed to be lived in? Or is it not allowed to be lived in at all because the destination is purely business? It would be nice if you could provide an answer to this and we will soon discuss it with the municipality...Lawyer
Definitely consult with the municipality. You now indicate that the function designation is: company home. This means that the relevant building/part of the building may only be lived in, and in relation to the company part of which the home is a functional part. The use of the home, for example, as (only) an office would then conflict with the intended use, as would occupation by persons who are not connected to the company that is operated there.Take the next step
