Municipality liability for damage caused by ice | Legal advice centre
Questioner
Good morning I fell off my scooter this morning. There was a warning about black ice and I was fully aware of that. I didn't see any black ice on my way to work until I came to a crossroads in Lisse and fell. All the cycle paths at the crossroads in question were gritted except for a small section (a kind of bypass). My question is, is there any point in holding the municipality liable for the damage to my scooter?Lawyer
Usually this situation is an exception. There was a warning. According to BW 6: 174 paragraph 6, the municipality has a maintenance obligation. You must then prove that there was a defect (photos of the location). The other party must prove that sufficient measures have been taken. You can try. Send a letter..Take the next step
