Pharmacy Liability: Your Rights and Options
Questioner
Dear employee, I have medications that I need to keep functioning and even to stay alive. These are delivered to my home mailbox every month by a pharmacy that is part of my insurance and that I have chosen myself. Last Wednesday I received a repeat email that my medication had been sent again as I receive every month. This means that the medication should have arrived last Friday at the latest. Unfortunately this did not happen. As of today I have no more medicines because they are finished, they still have not been delivered even though we have contacted them several times. The person in charge is very difficult and does not want to cooperate. Can I hold the pharmacy liable or take legal action? Thank you in advance, Yours sincerelyLawyer
If a delivery contract has been drawn up between you and the pharmacy, the latter must deliver the medicines. If they cannot do this or refuse to do so, you can hold the pharmacy liable. If it is a pharmacy with which you do not have a contract, you cannot derive any rights from this. You may be able to go to another pharmacy. For more information or further assistance, you can contact me directly and free of charge.Take the next step
