Legal assistance in the event of termination of a purchase contract
Questioner
Good day My ex-boyfriend and I signed a preliminary sales contract regarding the purchase of a house. Since the relationship has ended, I no longer want to buy the house together with my ex-boyfriend. Given my financial situation, I cannot buy the house alone either. I want to dissolve, my ex boyfriend doesn't! What he does want is unclear, he makes statements about it and doesn't want any contact with me. Can I do anything without him without his permission to withdraw from purchasing the house? Now it turns out that my last name is misspelled in the preliminary purchase contract Can I do something with this? Thank you in advanceLawyer
The purchase contract probably contains a condition precedent in case the financing of the house does not come through. If your ex-partner is able to get the financing, he can buy the house alone. You can then withdraw. If he cannot secure the financing on his own, the suspensive condition will apply and there will be no further problems. If the term for obtaining financing has already passed and financing is only possible if you both become owners, the contract will have to be terminated and you will jointly owe the penalty stated therein. The fact that your name is misspelled does not matter because it will be clear who the purchasing parties are. Consultation with your ex-partner is of course necessary. If this is not possible together, try to involve a mediator.Take the next step
