Dear Ladies and Gentlemen, My question is: my ex partner pays the alimony for our son properly. Now he will be 18 in October and he is still studying and lives with me (his mother) Is his father liable for maintenance until his 21st birthday? Father says that he no longer has to pay anything from the end of October/beginning of November this year (2016). Please give your feedback here Thank you in advance!

Your ex-partner is liable for maintenance until your son's 21st birthday, as long as he cannot provide for his own maintenance. This is regulated in article 1:395a BW. This article reads as follows: 1 Parents are obliged to provide for the maintenance and education of their adult children who have not reached the age of twenty-one. 2 During his marriage or registered partnership, a step-parent is obliged to provide for the costs referred to in the previous paragraph towards the adult children of his spouse or registered partner who are part of his family and who have not reached the age of twenty-one.
