Legal assistance with employment contracts

Questioner

I have a question on behalf of my sister (she went on vacation for a few days today) and this evening I hear the following from a colleague; her boss has not paid the rent for the shop (hairdresser) for 2 months, will be evicted in 2 weeks. This concerns a separate BV, separate from his other hairdressing salons. A few years ago he took over this business, including staff, no other employment contract has been signed. Now he wants to give my sister a six-month contract in one of his other businesses. He indicates that the BV my sister works for is not really bankrupt but that he is being evicted from the building. Is it true that the employment contract is no longer valid, because it concerns a separate BV? Her boss wants my sister to sign that six-month contract within 2 weeks, otherwise she will not be allowed to go to that other branch, other BV?

Lawyer

When a company is taken over, the employees continue to have the rights that they agreed upon with their previous employer. The employment contract also continues to exist. If your sister is only transferred to another branch but continues to do the same work, she does not have to sign a new employment contract. The current employment contract simply remains in force.
