Questioner

I have a little problem with my administrator. I made my first payment to the trustee in October 2013, with a debt of just under 7000 euros. I have worked full time since 2013 and have received a salary of 1200-1400 euros several times. My debt should have been paid off. Unfortunately, this is less true and the administrator in turn says that I must remain under the administrator for at least another 3 years, while I did not have to go to court for WSNP, but ended up under administratorship. My question now is, can I get rid of my administrator and how?

Lawyer

It is the administrator's job to keep you informed of the status of affairs. If she does not do this, she is in default. You have the right to inspect your file and can request it. It is best to request this in writing. This will give you proof. My experience with administrators is not always positive and they often have a habit of not wanting to cooperate. If this is the case, it is advisable to hire a lawyer to assist you and to request the file. Before you abandon the administration, it is important to know where you currently stand, the total debt according to the administrator, etc. If it appears that the administrator is making a mess of things, or has made a mess of things, it is advisable to initiate a case against the administrator and hold him or her liable for the damage. To get rid of your administrator, you can send a letter to the court with a request to terminate the administration. If you would like further help or advice, please feel free to contact me.
