Mandatory ID for Employees: Your Legal Questions Answered
Questioner
Can we 'demand' an employee to purchase an ID card. He must be seconded to the casino that requires this of the people who work there (the site does state that a driver's license is sufficient to enter) This employee refuses to purchase an ID.Lawyer
It is even legally required that an employer has a valid ID in the administration of the personnel file, and you can then also oblige the employee to have one. Also if your employee has to be seconded and does not want to get an ID., you cannot second him or her and or put him or her to work. As an employer, you are already obliged to check the identity of your employee using a passport, ID card or alien card and to keep a copy of it in your administration. So you may require the employee to purchase an ID card or passport and show it to you and allow you to make a copy of it. If desired, the employee may require you to place the text copy on the identity document when making a copy. A driver's license is not a sufficient proof of identity. Under the Identification Obligation Act, every Dutch citizen aged 14 and over is required to carry an identity document (other than a driver's license) with them when working. The employee is therefore obliged to purchase an ID card at his own expense.Take the next step
