Living together after divorce: advice on cohabitation agreements

Questioner

I got divorced a few years ago and want to live together again. I brought with me a financial debt from my previous marriage and do not want my new partner to be held liable for it. Partner has 2 children who still live at home, aged 13 and 18. I'm going to move in with my partner. Who can advise me on which type of cohabitation agreement would be best for us?

Lawyer

If you want to live together, there are no joint assets or debts. Other forms of cohabitation are a cohabitation contract, registered partnership, marriage. In all these cases, you can have a contract stipulate which part of the common property remains outside your cohabitation. This must be done by a notary. By the way, if you live together, you are often regarded as a fiscal partner by the tax authorities.
