Legal questions about ANW gap insurance

I am offered (by a new pension insurer) an ANW gap insurance (this is a pure risk insurance) via my employer. I have to pay the (high) premium for this myself. The insurance also expires upon termination of employment. My employer's letter states, among other things, the following: 'Don't have a partner? Then you can't participate in this insurance.' 'If you do have a partner, but still do not want to participate in the ANW gap insurance, you also sign the form and your partner must also sign for your choice'. This seems very strange to me. In fact, three options are given: 1. Yes, I'm participating 2. no, I will not participate (LET PARTNER ALSO SIGN) 3. no, I don't have a partner Apart from the fact that my partner is already outside the age range for payment of the pension (67 years), I do not want to participate in this scheme at all. Is the request of my employer that my partner, even if I do not want to participate, must co-sign legally valid? And what if I (disregarding his age) don't want to participate, and he doesn't want to sign? Go to court??
