Wage and holiday allowance: Your rights

Questioner

I have a question about the Wage and then I am talking about the 8% holiday allowance. My colleagues and I only found out months later that we did not actually receive this. We receive the minimum wage (as a Courier) and our contract states the minimum wage and that the 8% holiday allowance is included (0-hour call-out contract). What appeared to be not allowed after our own research, the 8% must be on top of the minimum wage. Now we have indicated this to the boss and he has therefore now also increased the wage. But our big question now is, are we not entitled to retroactive payment for the months in which we did not receive that 8%?

Lawyer

In short, you are entitled to the holiday pay that you did not receive in the past. You can claim this back up to 5 years.

You can claim the overdue allowance. I would like to draw up a claim that you can take to your employer.
