Legal Assistance with Secondment and Training

Questioner

I am doing a traineeship based on a secondment agreement. I signed a one-year contract. Since August, I have been doing work that I consider to be unsuitable work: since then, I have not been doing the work as described in the job description of the vacancy for which I applied at the time. The work is well below the level of the position for which I signed up at the time. Now I want to cancel in the meantime. However, I am also tied to a training agreement worth 5500 euros (training opportunities, training location, continued payment of wages, travel expenses, etc.). I have to work at least 2000 hours for the temporary employment agency or I have to pay back the amount in full. I have now worked for them for 1200 hours. There is no sliding scale included in the agreement and it is also not clear what the acquired knowledge can benefit the employee/employer in the contract. What are my rights? Can I terminate the agreement and indicate that I will not pay the fine?

The possibilities depend on what was agreed in the agreement. I am not aware of what is stated here and therefore cannot give a substantive answer. But from what I gather from your story, there is nothing else to conclude than that you have to finish the year and/or pay the fine. But to rule out the possibilities, I would have to delve into the matter. If you would like further help and/or advice, please feel free to contact me.
