Subletting and registration: What you need to know

Questioner

I would like to temporarily sublet my room and then move to a room somewhere else in the Netherlands. Can I be registered at an address and still live in the second home?

Lawyer

First of all, it is important to know whether subletting is possible. This is often not allowed or not allowed without the landlord's permission. In addition, you must (legally determined) be registered at the address where you live. If you do not do this, the municipality can start an investigation into you and if it is determined that you do not live there, you will be deregistered and designated as homeless if they cannot find your address and even label you as a fraudster. In addition, if you want to return and the subtenant does not want to cooperate, you must go to court. So it has more disadvantages than advantages and is certainly worth considering. And that is why I am not in favor of it. If you would like further help and/or advice, please feel free to contact me.

Questioner

I am allowed to temporarily sublet my room via a student housing corporation. In my case, that is allowed. The problem is therefore not that I cannot legally rent out my room. My room may therefore be sublet. I would like to remain registered at that address. Am I allowed to rent a room in the Netherlands while I am registered at my old address? Yours sincerely,

Lawyer

No. You must be registered at the address where you live. This is regulated in the Personal Records Database Act.

Questioner

I am going to do a temporary internship (6 months) in another city. This means that I do not intend to live permanently at the new address. Does it still apply that I have to register at my new address?

Lawyer

Yes. This is determined by law.
