Transferring a house after a divorce: what to do?
Questioner
Two unmarried cohabiting partners are separating. No cohabitation contract. Have a house that is in both names. One of the partners continues to live in the purchased house with the children (2). The house is in both names in the notarial (purchase) deed. The departing partner wants to transfer his share of the house to the remaining partner. What action must be taken to get the house in the name of the remaining partner who also assumes the financial obligations. What is the name of the action that the notary must take.Lawyer
You will have to talk to the mortgage provider, as they also have to give their approval to transfer the mortgage, and the notary must be approached for the notarial matters. As for the matters surrounding the termination of the relationship, a mediator can be called in to jointly put everything on paper. And since there are children involved, a parenting plan must be drawn up. If you would like further help and/or advice, please feel free to contact me.Take the next step
