Legal Assistance for Car Purchase Problems
Questioner
On April 20, I bought a second-hand car from a company. After the test drive, I thought the clutch was rather strange, but the salesman assured me that this is normal with the car and that it was just a matter of getting used to it. but it still didn't sit well with me and I had it checked and it turns out that the clutch is not good. the company where I bought the car does not respond to my emails and does not answer when I call or the person I need is not there. but before I want to submit this somewhere else, it is so that when I bought it I did not have a clear receipt, only proof of down payment and transfer proof from the rwd. and my legal assistance does not cover these kinds of problems. what can i do with this?Lawyer
Here the research and information duties of buyer and seller apply: if the buyer expresses doubt and a professional seller refutes the doubt, then the buyer may hold him to this. However, the problem is evidence if something has been agreed upon verbally.Questioner
but am I entitled to a guarantee or anything because nothing was mentioned or put on paper during the purchase and it is also not a BOVAG company. Does this fall under the consumer purchase guarantee?Lawyer
When purchasing a second-hand car, a buyer is expected to do some research, such as a preliminary inspection, and one may not expect the purchased (second-hand) item to be completely fine. If the buyer gives a negative answer to a clear question to the seller, as in this case, then there is non-conformity (a defect). However, you must prove one thing or another, and that is the rub.Take the next step
