Legal advice for damaged furniture

Questioner

We bought a new dining room (a table and 6 chairs). On the day of delivery the table appeared to be damaged. The delivery company wants to repair the table. We do not agree with this because we have paid a lot of money for a repaired table, while we are paying for a new one. What is the legal situation?

Lawyer

You are entitled to an undamaged table. So, give the seller written notice of default and state a reasonable period within which you want to receive the table. If you do not get what you want, you can cancel the purchase (the seller must then take the table back and refund the purchase price to you). You can also try to reach an agreement if you would like to keep the table with repairs, whereby you get a discount, because you are satisfied with a repaired table.
