Painter liable for damage to windows?

The painter worked on my house in the fall. During the sanding, several windows were seriously damaged with sanding scratches. The painter has already had a company come by to polish everything. Unfortunately, this did not work. I want the painter to fix the damage. This can only be done by replacing them. After months of pleading back and forth, he offered to pay 70% of the costs because the windows are 10 years old and he is going to install new windows. So I would have to pay 30% of the costs myself. To me, this does not feel like a fair solution. I have to pay to get the windows scratch-free again while they were fine before that. Am I within my rights if the painter is required to pay the full costs?
