Legal Advice on Holiday Home and Jacuzzi
Questioner
I have a holiday home on my own land at a holiday park. I would like to place a small jacuzzi in the garden. The park owner does not give permission and threatens to remove the jacuzzi if I install one anyway. The park regulations do not mention anything about placing jacuzzis. The park owner refers to an unclear rule in the regulations which states that in all cases not provided for in the park regulations, the management decides. What are my rights as the owner of the plot? Is the park owner entitled to remove things from my garden because with this rule in the regulations he is actually allowed to do anything and is therefore above the law?Lawyer
This depends entirely on the manner in which the park regulations are anchored. I understand that there is no question of a division into apartment rights. In that case, it will probably be included by means of easements, qualitative obligations and chain clauses (with or without penalty provisions) that the owners are bound by the park regulations. These often include that the plot must be arranged to the satisfaction of the park manager. If that is the case, then you are bound by it. There are also other regulations, not all of which are equally watertight for the operator/manager of the park. If necessary, I can study the regulation further and assess whether in your case the installation of a jacuzzi is permitted (in that case, please contact me directly).Take the next step
