Cat nuisance and legal responsibilities

Questioner

I want to put strips with pins on the fence to keep cats out of our garden, our neighbor (who the cats belong to) immediately said if the cats hurt themselves I will sue you. Now my question is if I install these pins on my fence am I responsible for hurting the neighbors cat?

Lawyer

Yes, if you damage a property/product of the neighbours, because according to the law the cat is a good, then you are responsible for it if you deliberately damage it. In addition, if a fence is on the property line, the fence is jointly owned. To limit the damage, my advice would be to place electric fencing to deter the cats in this way without causing direct damage to the cat. However, your neighbour must ensure that you are not inconvenienced by the cats and you can also speak to her about this.
