Legal Assistance with Debt Collection Problems
Questioner
Letter of collection while product has been returned Was first 'company name' (sounds familiar to me because of the product), collection agency is the next. Unfairly, I received a package months ago that I did not order. Rudeness!! This concerns 'purely advertising product'. I went to check on the internet what the product is, I sent it back (not registered, which was requested, but really did not want to spend more on that). So I have already incurred costs to have a product sent back that I did not initially request. Suddenly I see payment slips passing by that I have to pay it?!?!!! With the end result that I received a letter from a collection agency whether I would like to pay € 90.40 otherwise they will take legal action (should have been paid by July 20th). Now in this letter there was a link with a login code to ask a question (or payment arrangement) but this link does not exist, they do refer to the normal website. Here you can ask a question, but it made me decide not to do that for a while. I don't trust it. Now I have filed a complaint about this via 'name of the site where you can complain' and the company came up with this solution: Dear ...... We hereby send you an email in response to your message to 'name of the site where you can file your complaint'. Due to the lack of full payment, the claim has been transferred to the Collection Agency. We would like to advise you to file your objection to this claim with them. We hope that this information provides you with sufficient information. Yours sincerely, Company name What do you mean, solution? On the company's website you can contact them, but the same text appears. Now I'm not the only one, but this doesn't give me a good feeling at all. Now I have started to delve a bit more into this online, I also see messages everywhere on Facebook but also various sites where you can file your complaint. Negative. Can someone please advise me on this? Please!! Do I have a leg to stand on? I am afraid of those collection costs. Kind regards.Lawyer
If you did not order the package and returned it, you do not have to worry. I advise you to inform the collection agency in writing (with a copy to the company) that you did not order anything and will not pay and that you therefore have nothing to do with it. It does happen that some companies engage in such malpractice in the hope that consumers will pay anyway.Take the next step
