Legal advice for complaints about floors
Questioner
Last year, a PVC floor was laid in my new-build home. I already had complaints about the floor during the laying process. In my opinion, there were wide gaps in a number of places. The company said that this was allowed, it was within the margin. After delivery, there were even more complaints from my side, strips with bubbles underneath. A number of complaints were resolved, but now a year later, a number of bubbles are still visible. The gaps were filled with sealant as a solution. This sealant was not properly cleaned off the floor itself, so that dust quickly sticks to it and this is quickly visible as dirty streaks compared to the other strips that do not have sealant on them. This sealant can no longer be removed with a cleaning agent. The company now offers to sand the floor and glue a new floor over it. I have made inquiries with two other companies and they do not talk about sanding, but pulling out the current floor and then laying a new floor. So now I have my doubts about the solution offered. Also, I have no more confidence in the company, why would it go well this time? Can I hire an independent expert for this? Can I perhaps claim compensation, so that I can go to another floor layer myself? This is what I would prefer to do. The relationship between the company and me is currently very tense, because I doubt the solution offered. I also have underfloor heating as my main heating, which is why I am not reassured about an extra floor over the current one, because of more heat resistance.Lawyer
The floor layer must solve the problem, which means you cannot go to someone else sooner. This is only possible if the floor layer does not want to or cannot repair the floor. In this case, I advise you to discuss with the floor layer the possibility of calling in an expert who will then have the final say. The costs incurred by the expert will then be paid by the 'loser'. If the floor layer fails to repair the floor several times, you can indicate that the floor should be repaired elsewhere at his expense. For direct assistance, you can contact me directly if desired.Take the next step
