Liability in horse stables | Legal advice centre

Questioner

I am stabled with my horse at a livery stable/riding school. There is also a stallion stabled here. He is in the first box so everyone has to walk past him. By the way, the box is not completely closed off. Now it is the case that there are also children between 8 and 14 years old stabled in this stable with their mare ponies. Suppose the stallion breaks out one day. (He has already partly loosened the front panel by his pounding on it when horses walk by) Who is then responsible if something happens to the horses or in the worst case to the children?

Lawyer

The owner of the stallion is in principle liable for damage. However, the owner of the riding school can also be held liable if it turns out that the stable is rented and it shows defects that have caused the stallion to break loose.
