Questioner

Through acquaintances of mine who have a cleaning lady as an informant, I am accused of pedophile sexuality by the owner of the village pub in my village Oudehaske. Could I ask her in the presence of guests if she accuses me of this and if she answers this, also confirm it in writing? And if she accused me behind my back, could I legally sue her for slander and libel?

Lawyer

A person may be guilty of the criminal offence of defamation if he/she discredits the honour or good name of another by accusing that other of a (serious) criminal offence. The criminal offence must be brought to the attention of the public (i.e. it must be publicised). The criminal offence of defamation may occur if the person knows that what he/she is spreading is not true. For example, if the proprietor spoke to her guests about your alleged actions, she may be guilty of libel or slander. If the proprietor only reported the incident to the police, she is not guilty of these criminal acts. However, there may be a libelous charge if she reported the incident to the police in order to harm your honor or good name. If you are considering reporting a criminal offence or if you receive a summons for questioning from the police or the judiciary, you can contact us directly if you wish.
