Claim damages from a contractor after renovation?
Questioner
After the renovation of our home, it turns out that much of the work was done improperly. Repairs need to be carried out. To date, the contractor has not wanted to repair the damage items. We now want to recover the damage so that another contractor can get started. The wrong contractor has now deregistered from the Trade Register. On the same day, the wrong contractor started a new company with a new Chamber of Commerce number. Can we still recover the damage from the wrong contractor?Lawyer
In legal terms, my answer is yes. In practical terms, there are some thresholds to be expected, especially if your contractor was/is a legal entity (''BV''). You must then take into account that you are dealing with a 'bare chicken', with the risk that even if you are proven right after legal proceedings, it may be very difficult to actually get your money. In any case, ensure that you give the contractor written notice of default, stating what is wrong and by what date the defects must be remedied.Lawyer
The mere fact that the company has been deregistered from the trade register does not mean that the contractor can no longer be held liable for the defects in the work. If it was a sole proprietorship, any claim for damages against the contractor can be recovered privately. Before you have the repair work carried out, it is wise to first have it checked whether you have met all the legal requirements for this.
