Rental Agreement and Shell Delivery: What to Know?
Questioner
If a lease agreement (retail space) states that the building is rented as a shell, does this also mean that the building must be delivered as a shell? And isn't this a binding condition that the landlord must adhere to anyway?Lawyer
This depends on what else is stipulated in the agreement or associated conditions regarding delivery, matters that are forfeited to the tenant, etc.Lawyer
The rented property must be made available to the landlord at the end of the lease. The law does not require it to be returned to its original state, unless a description of the rented property was made at the start of the lease. In that case, the rented property must be returned to the landlord in that state. If the landlord has agreed to changes to the rented property, you do not have to undo these changes upon delivery. However, if something different is stipulated in the rental agreement, that will in principle take precedence.Take the next step
