Legal Assistance for Car Purchase Problems
Questioner
First of all, thank you very much for the opportunity to call upon your knowledge in this way. I have the following problem. On October 8th I bought a car. The purchase price was trade-in (+/- € 1,000 / according to invoice € 1, -) plus € 2,750.00 (According to invoice € 2,751.00) by bank at a RWD recognized garage. This was my third purchase from them in the past +/- 10 years. The 'new' car is a Citroën C4 from 2006, mileage was < 160,000 (diesel). On 22.10.2016 (less than 2 weeks later) I had a breakdown, and the ANWB was kind enough to take the car to a storage facility and return it to the garage where I had purchased it on Monday. The communication from the garage was minimal. I was promised an update several times which unfortunately had little reality. To make a long story short.. They now tell me afterwards (2-2.5 weeks later) that I could have purchased additional warranty and since that did not happen, I now have to pay extra for the costs. They indicate that they have incurred € 1,500.00 in costs for the following repairs: replacing the head, camshafts, injectors & bleeding. They also indicate that they are prepared to do the costs 50-50. This means that I now have to cough up € 750 without consultation. They also indicated that if I do not have such an amount at the moment, I can pick up the car on condition that I enter into a payment arrangement with them. Would you be so kind as to inform/advise me what my rights/obligations are? I would like to have a conversation with them soon, but would like to know my rights/obligations first. They also informed me that they did not have a replacement car available, which has resulted in a lot of costs for public transport, unused parking permits and BPM for 2.5 weeks now, and given the lack of information I have had to adjust my schedule several times. Your advice is highly appreciated! If you need any further information, please let me know.Lawyer
The garage has evaded the duty to report (purchasing additional warranty) and also neglected to mention that the car is in very poor condition. The mileage also raises questions, but that is beside the point. All costs you have incurred are consequential damages. And these will have to be reimbursed.
