Liability claim: What now?

I have been held liable for damaging a canvas roof on a car. My WA insurer wants to speak to the injured party by phone. The injured party refuses but is prepared to answer questions in writing. Is the injured party obliged to speak to the insurer by telephone?

The injured party is not obliged to speak to the insurer by telephone. Written communication is also permitted and it is then up to the insurer whether they wish to respond further to this if they wish to obtain evidence.
