My dog is lying on a lawn with a tennis ball between his front paws. Another dog comes running and runs a few laps around him. On the last lap, our dog nips while the other dog runs past him. In the process, one of our dog's canines hits his flank, resulting in a large gash that requires multiple stitches. Both dogs are not on a leash, this is permitted by APV. The owner of the biting dog is in principle liable for the damage caused. In this case, it does not matter whether the dogs are loose or on a leash.
