Legal Advice When Buying a Car: Your Rights

Questioner

I recently bought a second hand car from a dealer. After agreeing on a price, a contract was drawn up by the seller (standard BOVAG contract), signed by both parties and the sale was concluded. Now I got a call from the seller that he had made a mistake in the amount when filling in the contract and upon checking it appears that the amount stated on the contract was indeed lower than was verbally agreed. The request was to dissolve this contract and correct the amount. Regardless of any fairness, what are my rights in this?

In principle, a valid agreement has been reached. If there is an obvious mistake by the seller regarding the amount or it should have been clear to you that there is an incorrect amount, the seller can terminate/adjust the contract. If the difference between the amounts is not large, you may assume the original contract and the seller must adhere to it. For more information, you may contact us directly via a private message.
