Liability for a broken CV pressure vessel - Advice

Questioner

We have been living in our new house for three weeks and now it turns out that the pressure vessel of the central heating has broken. The entire central heating system was checked by the owner last year and annual maintenance has been carried out. The central heating system is approximately 5 years old. Can I recover the costs of the new pressure vessel from the previous owner?

Lawyer

It seems to me a case of normal wear and tear/breakdown after the moment you became the owner, the previous owner is not liable for this. That would be different if you could prove that the breakdown was already there at the time the purchase was made and the previous owner was aware of it at that time but concealed it. With a CV installation that is 5 years old, there may still be the possibility to claim this under the warranty, the right to warranty has been transferred to you.
