I have a question about the right of withdrawal. I want to cancel a purchase via an online auction site. According to the auction employee, this is not possible because it is a bankruptcy auction and the right of withdrawal does not apply. However, there was no possibility of viewing and everything is done online. The reason is that the lot only contains one speaker instead of a set, as I expected, but that doesn't seem relevant to me. In the Explanatory Memo of the EU Directive of 2013 it is stated that foreclosure goods are not covered by the right of withdrawal. 'Finally, it is noted that foreclosure auctions are completely outside the scope of the directive - regardless of whether they take place online or offline (cf. If it concerns an online auction, the right of withdrawal applies. This does not apply to a public auction or a bankruptcy auction associated with it.
