Embezzlement and Confiscation: What Now?
Questioner
I was convicted of embezzlement 2 months ago. It was about an amount of 3900 euros for which I was convicted. Now I receive a letter with the summons for the confiscation case. (This was also the expectation) however the public miniseries indicates that they want to confiscate 39,712 euros. Is this possible if you have only been convicted for 3900 euros? Is the evidence different or? I would like to know more about this.Lawyer
Embezzlement is a criminal offence, punishable by a (maximum) fine of the 'fifth category'. As a result, the Public Prosecution Service can (1) deprive you of the unlawfully obtained benefit of the act for which you have been convicted, but also (2) for 'other criminal offences', if it is plausible that those other acts have led to unlawfully obtained benefit. In short: yes, the Public Prosecution Service can also claim confiscation of the €39,712. However, the amount must be well substantiated by the Public Prosecution Service. Your interest is great.
