We have a shared driveway with our neighbours and we have had a carport installed here together. Now we recently wondered what happens if one of us moves in the future and what the rights are of new residents. For example, can they say that they want to tear down the carport? Or is a carport part of the property and is a new resident 'obliged' to leave it standing / 'accept' it? And are there any more legal tips and tricks for a shared carport? For example, regarding mutual agreements between us and the neighbours with whom we share the carport?Lawyer
If a joint building is erected on the land of two owners that is permanently connected to the land, a joint property and a simple community are created. (Book 5 BW Title 5 and Book 3 BW Title 7) The law then regulates what the rights and obligations are. A claim for division is excluded.
