Advice on liability debt of a general partnership
Questioner
My question is about leaving a general partnership. At the time of exit, the company had a debt. It has been agreed in writing that the partner who continues the partnership will fully assume the blame and release me (the outgoing partner) from it. However, the bank with which the debt is owed still holds me liable. My question now is Can the bank now hold me liable for this debt? And is there a way to get my name off of this? Thank you in advanceLawyer
Yes, externally, because you are jointly and severally liable for the debt, but between the members of the partnership, you have the right of recourse for everything you pay above the agreements, which is every euro that the bank demands from you. You could request to be released from joint and several liability.Take the next step
