Legal tips for building a canopy
Questioner
I want to build a (detached) canopy at the back of the garden. The canopy borders the neighbours behind us and the neighbours next to us. The other side borders the municipal park (approx. 1 metre wide, then public road). Possibly also place a pizza oven. What do I need to take into account: - height? - surface area? - distance between property boundaries? - environmental permit? I'd love to hear it! Kind regardsLawyer
Building on the backyard is permitted without a permit, see: https://www.rijkoverheid.nl/onderwerpen/bouwregelgeving/inhoud/checken-of-vergunning-nodig-is-voor-ver-bouwen/vergunningvrij-bouwen-en-verbouwen If what you want to build is not permitted without a permit, you must apply for an environmental permit from your municipality. The zoning plan determines for which construction works a permit can be issued. Sometimes an environmental permit for deviating use must also be applied for. As long as you build on your own land, the neighbour law does not impose many obstacles on you. You may not cause unlawful nuisance. This could be the case, for example, if the construction blocks a lot of light from your neighbours. You must also arrange drainage via your own plot. Some municipalities also impose requirements on wood burning, precisely to prevent odour and smoke nuisance.Take the next step
