Reclaiming a bridging mortgage | Legal aid centre
Questioner
The bank forgot to include my bridging mortgage in the repayment statement, it turns out 9 months later. Now I have been approached by the bank that I still have to pay the bridging mortgage (a standard call about the status of the sale of the house - not because they had noticed that this had been left behind). I myself assumed that this had all been arranged as stated in the note of my mortgage deed. Because the bank made a mistake, forgot something, I now have to pay an amount of more than 3000 euros. At the time, that could have been averaged with the equity of the house / restitution costs that we got back at the time. Now I have to solve this like this (equity etc. has of course been spent on renovation costs / furnishings of the new house). What are my rights now? Can I recover anything from the bank?Lawyer
The bank has a duty of care towards you, i.e. it must inform you well about the state of affairs and perform correct calculations that may be important to you. Now that the bank has forgotten this, you can recover the damage you suffer as a result from the bank. At first glance, this seems very likely to be possible.Take the next step
