I have a trial membership at a sports and slimming studio in Bergen op Zoom but I want to cancel it. There is only 1 toilet and no shower room and in the changing rooms there is no heating and running water. I find this a serious shortcoming. However, they require me to complete my trial subscription for a monthly fee of 67.50 euros. How can I cancel this trial subscription? Thanks for your adviceLawyer
A trial subscription must also meet the requirements that you could expect based on the services offered. So it does depend on what you have been offered and/or whether there is a shortcoming. You must send a notice of default and also a default because it is not obvious that the shortcomings will be resolved within the trial period, then you demand your money back. Thank you for your response. During the introduction and tour, the changing room, showers and toilets were not discussed. I did not ask myself any questions about this, as you assume that these are present in every fitness establishment. In addition, I am currently struggling with a lack of time due to both family and professional reasons. I have already discussed this with them, but they do not give in to this. In their eyes, I might as well come and exercise at the beginning of the day. They are willing to temporarily suspend the trial subscription but want me to continue paying my monthly contribution. I will then get the money back after I have been able to complete the trial subscription. This does not seem okay to me and I have therefore stopped my direct debit. That's why I thought it would be a good idea to put them in default and use the problem with the showers and toilets as an argument. Do you think this is possible?
