Legal assistance with car purchase problems
Questioner
On April 15, I concluded a purchase agreement for a Peugeot 207 SW for which I paid €500,- down on that day on an amount of €5500,- which we agreed upon. According to the advertisement, the car is from 2008, has run approximately 72,000 km with NAP and is delivered with maintenance papers. · · April 19th was the first telephone contact. With the question whether the license plate was already known in connection with arranging car insurance. The license plate was not yet in their possession. The question was asked how this could have happened since they should have been in possession of the registration certificate. It turned out that the car had been imported, the country of origin is unknown, it is advertised that NAP is included, how is this possible if the car does not come from the Netherlands. · · April 21st contacted the company again. License plate known: NT-360-V. On the RDW website it appeared that the car was from 2007, not 2008. I called the company the same day and indicated that I was buying a car from 2008, not from 2007. I was called back later and was told that it was a misunderstanding, he agreed with me. The seller suggested giving a 12-month warranty on all moving parts instead of 3 months, excluding labor costs, and after a lot of discussion the company deducted a total of €500 from the price. · · Again contacted the seller that I completely withdraw from the sale because nothing is correct about the sale. This was not possible and I was told by telephone that I had to pay back 25% of the purchase amount due to cancellation, this sign would be on their counter, which by the way has never been there. Finally made the purchase, the seller responded very aggressively by phone and I would not get my €500 back under any circumstances. Because we could not get out of the purchase, we bought the car. Now it turns out that besides the fact that there is no NAP, because the car has been imported, the car is from 2007 instead of 2008, the car still has several defects for which the car has already been returned twice. The car has been back 2 times since the purchase on April 26 due to defects. The car has not yet been repaired and I get the car back in an increasingly worse condition. I could take it back now, but it will probably be tied together with strings again. I will go elsewhere to get my story and will call the cashier. The defects are a broken/non-working key (this is held in place with an elastic band), the radio does not turn off when the car is turned off, ESP light was on, the car was brought back for that, now the ESP light is not on, ESP does not work at all now, ESP is now completely switched off and also partly because of that the information display is off/broken, When the car starts, no ESP light comes on before the car is restarted. Control panel in the door still does not work properly. This has been repaired, but the buttons ultimately do not work properly. The car was also MOT tested on April 24, the inspection report states that the exhaust had repair points that have been made, however the exhaust still seems broken because it continues to make a sporty sound. I could take it back now, but it will probably be tied together with strings again. In the meantime, the car has been checked over at the Peugeot dealer. To begin with, these indicate that the mileage is questionable. Further defects: Air Conditioning Stinks Front + rear wiper blades bad Key defect Battery bad Right rear sill rusted through Left rear brake is sticking exhaust supports almost all broken off Oil leak vacuum pump Coolant leak, temperature sensor defective Camshaft adjuster malfunction Replace ABS/ESP module fault Letters sent for notice of default, cancellation of purchase, unfair trade practices, but this was to no avail. Also contacted Consuwijzer as well as legal assistance. However, legal assistance and a dispute committee indicate that they can do nothing because they are not a brand dealer and not affiliated with BOVAG. This is really worthless, I can conclude from that that it is a real FLUT company. I have emailed again today with my findings and informed them. The response back was that they have kept to the agreement, that the defects are not covered by the warranty and that they are going to hire a lawyer, where they will also recover the bad review that was placed by us and that we reacted angrily to the situation towards them from the lawyer. Whether this will actually come to fruition remains to be seen, but I have been duped for a considerable amount and will have to sell my car for a paltry sum and buy a new car given the need for a car.Lawyer
This is a sad story, it is annoying that you were taken for a ride. There must be something that can be done about this, I am thinking of dissolving the purchase and refunding the purchase price. From your story I gather that you have legal expenses insurance. They cannot simply give it up. Would you let me know if that is the case? If you wish, please contact me directly. Then I can see what I can do for you.Take the next step
