Traffic Fine BV: Advice and Solutions
Questioner
A company (BV) has an outstanding CJIB traffic fine. BV is dealing with inability to pay. It is working on dissolution. However, last week the police were at the door twice. The police have requested to pay the fine as a private person, this because of director's liability. They even threaten with possible hostage-taking or seizure of any other vehicle. Explained to the police that the BV no longer has any assets, and therefore no car either. This morning another police visit, they again mentioned that up to 7 days of hostage-taking of the BV director can be imposed. What is the solution now? Try to make a deal with the CJIB in private to get rid of this issue.?Lawyer
You can submit a request to the CJIB for a payment extension or to agree on a payment arrangement. Whether you are personally liable, as the police indicate, depends on your BV. Are you the sole owner, are there multiple owners? Have you been negligent in the management or in paying the fine? The best advice I can give you is to contact the CJIB, indicate that it concerns a BV and that you are not personally liable (initially) and then find a solution.Take the next step
