Advice on Labor Disputes and Pension Problems
Questioner
Ir/Madam, Since I am completely disabled, I will receive an IVA benefit as of June 25th. This is how I discovered that I have not built up a pension for the last 2.5 years through my employer, but have paid my monthly premium through my salary. I have spoken to my employer about this and made him a proposal. I have also made him a proposal regarding my dismissal (transition) (compensation). I have tried to contact him several times and indicated that it will be a short day (June 25) to reach a settlement. My requests are not responded to. My question is: Should I take legal action now, or should I wait to see what he is going to do until these dates and then take action. It can't be his intention to continue my permanent employment contract dormant and not compensate anything. Please advise on this. Yours sincerely.Lawyer
If the employer does not respond to your letters/requests, you should go to a specialized labor lawyer asap. Often the first consultation is free, like in my office. There are employers who do not terminate. In that case they do not have to pay the transition payment (TV). Collecting pension premiums but not paying them is fraud/theft and contrary to good employer practices. You can therefore also report this to the police. An expert lawyer can also provide you with further information on this point.Take the next step
