Legal assistance with BVA auction problems

Questioner

I bid on a lot at BVA auction and won. On my way there I was called to say that the lot could not be found and that I did not have to come. Two days later I received a notice that the next day was the last pick-up opportunity for my won lot. I then went to arrange a delivery because I could not that day. It turned out afterwards that the lot simply does not exist. Can I have BVA deliver the lot now?

Lawyer

I don't quite understand your story. Does the lot exist or not? If the lot does exist, the conditions under which the lot was purchased apply.

Questioner

The lot existed otherwise there would have been no bid that I won. On the collection day I was informed that the lot is no longer there and cannot be found. I had already paid in the meantime (I did get my money back). My idea is this; maybe I could have made a profit with the lot.

Lawyer

Unfortunately, if the lot is apparently untraceable, it can no longer be delivered. I cannot simply judge whether BVA auction is liable for damages
