Inheritance Law in Brazil: What to Do?

Questioner

I have a question about drawing up a declaration of inheritance in Brazil. I have to draw up a declaration of inheritance in Brazil with my Dutch sister in connection with the death of my father. He worked and lived there (not emigrated), and also has a Brazilian girlfriend and daughter there. (there is no will) Now I know that according to Braziliaasn his girlfriend is entitled to the declaration, in addition to the other 3 children (despite the fact that there is no cohabitation contract and/or ger. partnership). I also understand that Brazilian law is used to the advantage of the Brazilian heirs (whatever that means?). There are assets in Brazil (bank account + 1 house) and in the Netherlands (bank account). I ultimately have to go to the bank in the Netherlands with that declaration (with a power of attorney) to be able to open the account there again. My Brazilian family does not want us to have any further access to the house and bank and they do not want to have access to the Dutch account and have had a lawyer draw up an inheritance declaration, which we are going to sign. What should we pay attention to and what is/is not possible?

Ir/Madam, Since I am not familiar with Brazilian inheritance law, and apparently neither are my colleagues here, I advise you to contact a notary. Yours sincerely, HermanAlbersen Lawyer
