Assistance with damage to rental car | Legal aid

Questioner

Good morning, I rented a car through a rental company. During the rental contract I was hit from behind. Now the landlord indicates that this will cost me my own risk. Can someone tell me if this is allowed? He will also receive the money through the insurance. Then he would earn on the damage suffered for which I am not the culprit? I'd like to hear it. Yours sincerely,

Even if you are not at fault for a claim, the insurer can charge the rental company an excess if the claim is covered. The latter will then charge you the excess. Only when it is certain that the excess will be reimbursed by the other party (which does not happen often), can you claim this amount back from the rental company.
