Liability for car accident during working hours | Legal Aid
Questioner
Last Thursday I had a car accident during work hours with my car (private property). Fortunately, there were no injuries to either party, but my car is so old (2003) that my car is only WA insured. Now the accident is most likely my fault (no reckless behavior and/or means involved: police signed) so I will have to pay for the damage to my car myself. In what sense/capacity is the employer in the 'game' here? I have a full-time employment contract and need transportation for my work (Sales Consultant). I would like to hear/read from you. Thanks in advance.Lawyer
If you cause a traffic accident with your own car during working hours (except for commuting), then in principle the employer is also liable for this, even if it is your fault. The employer must ensure that there is good insurance for traffic accidents and must behave as a good employer. I advise you to hold your employer liable for the damage, of course after proper consultation.Questioner
Thank you for your message. I have already been in contact and they say that they have no insurance and therefore cannot do anything for me. I would like to know what the steps are to hold my forgiver liable for this. I would like to hear/read from you. Thanks in advance.Take the next step
