Legal questions regarding inheritance and debts
Questioner
My ex and I are divorced and have 1 minor daughter. He is now seriously ill. Is my daughter the one who has to decide on his funeral etc.? Can she be burdened with that? And what about debts he has? He has no will or anything registered with his father has no own house. Is my daughter entitled to anything?Lawyer
The estate of a person without a will is distributed according to the statutory distribution. In the event of a death, the children inherit. It is not the case that debts cannot be inherited. If you wish, you can contact us without any obligation.Lawyer
Debts also fall into the estate. It is therefore wise that you accept the estate under benefit of inventory on behalf of your minor child. This means that if there are debts, these will not be for your daughter's account and if there is a positive balance, your daughter will inherit. Your daughter does not have to pay for the funeral. Now that your ex is registered with his father and apparently staying there, it seems to me that the father should arrange everything. if necessary I will be happy to help youTake the next step
