Costs of a pro bono lawyer after selling a house

Questioner

I was given a pro bono lawyer during my divorce. My own contribution was minimal for this, because I have little income. The jointly owned house has still not been sold or taken over by my ex-husband. There is a surplus value on it. If this money is released, do I still have to pay my lawyer's costs? How much of your own money are you allowed to have with a pro bono lawyer?

Questioner

Suppose I get 20,000 euros after selling the house. That is more than half of the assets I am allowed to have. Then I have to pay back all the legal costs? That can never be more than what I received, or will I still go bankrupt?

Lawyer

If the Legal Aid Board withdraws your legal aid, you will be required to pay your lawyer's commercial rate.

Can my lawyer's costs be more than my assets?

Lawyer

yes that could be possible in theory. if all goes well you were also told at the beginning of the case what the hourly rate is if you do not receive or retain legal aid.
